These Terms of Service ("Terms") govern your use of tarunthapa.in and any digital marketing or IT services engagement with Tarun Thapa ("I", "me", "my"), an independent digital marketing and IT services provider based in Dehradun, Uttarakhand. By using this website or engaging my services, you agree to these Terms.

1. Services Offered

I offer digital marketing and IT services including but not limited to Meta Ads, Google Ads, LinkedIn Ads, lead generation, graphic design, AI video creation, CRM development, app development, AI automation, and website development. The exact scope, deliverables, timeline and pricing for any engagement are agreed upon individually with each client, typically following a free discovery call.

2. Engagement Process

Enquiries submitted through this website are not a binding agreement to provide services. A working relationship begins only once both parties agree on scope, pricing and terms for a specific project, whether over call, WhatsApp, email or a written proposal.

3. Payment Terms

Payment terms (amounts, schedule and mode) are agreed upon individually per project and communicated directly to the client before work begins. Ad spend for platforms like Meta or Google Ads is separate from any management fee and is typically paid directly to the ad platform by the client, unless otherwise agreed.

4. No Long-Term Lock-In

Ongoing services are generally provided on a month-to-month basis with no mandatory long-term contract, unless a specific project (such as app or CRM development) requires a fixed-scope agreement due to its nature. Either party may discontinue an ongoing engagement with reasonable notice as agreed at the start of the engagement.

5. Client Responsibilities

Clients are responsible for providing timely access, approvals, brand assets and information needed to carry out the agreed work, and for ensuring their own compliance with the advertising policies of any third-party platform (such as Meta or Google) used as part of the engagement.

6. No Guaranteed Results

Digital marketing outcomes — including but not limited to leads, traffic, rankings, sales or return on ad spend — depend on many factors outside my direct control, including market conditions, competition, platform algorithm changes, and the client's own offer and pricing. I do not guarantee specific results, rankings or revenue figures for any service.

7. Intellectual Property

Unless otherwise agreed in writing, final deliverables (creatives, campaigns, code, designs) become the property of the client upon full payment. I retain the right to showcase completed work in my portfolio unless the client requests confidentiality in writing.

8. Limitation of Liability

To the maximum extent permitted by law, I am not liable for any indirect, incidental or consequential damages arising from the use of my services or this website, including loss of profits, data, or business opportunity.

9. Third-Party Platforms

Services involving third-party platforms (Meta, Google, LinkedIn, WhatsApp, hosting providers, etc.) are subject to those platforms' own terms and policies, which are outside my control. I am not responsible for outages, policy changes or account actions taken by these platforms.

10. Governing Law

These Terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Dehradun, Uttarakhand.

11. Changes to These Terms

These Terms may be updated from time to time. Continued use of this website after changes are posted constitutes acceptance of the updated Terms.
